What paperwork do I need when working with a seller?

For listings (when selling a home), you’ll need a listing agreement and relevant disclosures.


Listing Agreement

You have options as for which agreement you use but you must use a Kale listing agreement (there are several options below), and not the association agreements (CAR, MORe, NSBAR, etc.). If you do not use a Kale listing agreement you will be asked to obtain the proper listing agreement signed prior to the listing being activated on the MLS.

Listing agreements are found in dotloop under templates. Once you click templates you will click KALE REALTY DOCUMENTS.

Listing agreements you can use

  • Kale Exclusive Right to Sell Agreement 6% (if you are charging the seller a 6% commission, use this.)

  • Kale Exclusive Right to Sell Agreement Variable Commission (use this if you are charging the seller a commission other than 6%)

  • Kale Exclusive Agency Sale Agreement (only use this if your sellers want to also try to to sell the property themselves, in which case no commission would be owed to you. You would still earn a commission if you secure the buyer.)

Disclosures

You must have all disclosures signed and uploaded into dotloop prior to a listing being activated on the MLS.

The following disclosures can be found under templates. Once you click templates you will click KALE REALTY DOCUMENTS.

  • Kale Affiliated Business Disclosure

  • Kale Anti-Fraud Notice

The following disclosures can be found under the template section of dotloop. Once you click templates you will click on the folder for your local REALTOR association (CAR, NSBAR, MORe, etc.) and locate the forms listed below.

  • IAR – Seller Disclosure Form

  • IL – Lead-Based Paint Disclosure (only required for properties built prior to 1978)

  • IAR – Radon Disclosure Form (only required for units below the third floor)
