Wholesaling Is Not Allowed at Kale Realty

At Kale Realty, we operate with a clear standard: we represent clients, we follow the law, and we protect our agents and the brokerage. Because of that, wholesaling is not allowed at Kale Realty.
This policy applies to all Kale Realty agents, teams, and anyone conducting real estate activity under Kale Realty’s license.
What we mean by “wholesaling”
For this policy, “wholesaling” includes activities such as:
Marketing or advertising a property you do not own and do not have the legal right to sell
Putting a property under contract and then trying to assign the contract for a fee as the primary business model
Advertising “investment deals” or “off-market properties” where the agent is not the owner and does not have a valid listing agreement
Collecting or promoting “assignment fees” tied to contract transfers instead of a standard brokerage transaction
If the primary intent is to profit from assigning or flipping contracts rather than representing a buyer or seller in a traditional brokerage role, it falls under wholesaling for purposes of this policy.
Why Kale Realty does not permit wholesaling
Wholesaling can create serious risks for everyone involved, including:
Legal and licensing exposure if marketing is done without proper authority
Consumer protection issues when terms, property condition, or pricing are unclear or misrepresented
Advertising and disclosure problems that can trigger complaints or enforcement action
Reputation risk to agents and the Kale Realty brand
Kale Realty’s job is to help agents build long-term, compliant businesses. Wholesaling doesn’t align with that standard.
What is allowed instead
Kale Realty agents are welcome to work with investors and do investment-related transactions in a compliant way, including:
Listing properties with a signed listing agreement
Representing buyers, including investor buyers, under proper agency agreements where required
Selling properties you personally own (with proper disclosure and brokerage approval as applicable)
Standard purchases, sales, and rentals handled through normal brokerage practices
Questions or situations that are “close”
If you’re unsure whether a specific situation crosses into wholesaling, don’t guess. Bring it to the managing broker (Rick Williams) before advertising, contracting, or collecting any fee.
Bottom line: Wholesaling is not allowed at Kale Realty. We focus on compliant, professional transactions that protect clients, agents, and the brokerage.
